Webforge ordered to compensate worker after dismissal for unsafe practices

WEBFORGE has been ordered to pay a worker nine weeks’ of pay, after unfairly dismissing him due to unsafe work practices.

Webforge NSW fired Mohamed Ahmed on 29 September 2009, after he entered a GW3 welding machine to realign welded panels, and aggravated his pre-existing back injury.

The company deemed this unsafe action reason for terminating Ahmed, who has worked for the company for 15 years. He was also team leader of the cutting section.

The worker claimed unfair dismissal. Fair Work Australia found in his favour, and said the company should have considered other disciplinary options for the unsafe action.

Fair Work Australia found reinstatement to a supervisory role was not viable, so it ordered Webforge to pay compensation equivalent to nine weeks’ pay.
